Re: My legal experience w/ CFIDS ..so far..
Hi,

I very seldom write to this list, but have had the same experience. I have
chronic fatigue that never went away after high dose chemo (AIM). I had LTD
insurance through the company I worked for. I never could go back to work
full time.

Eventually they denied my claim. They sent me for psychological tests,
pulmonary tests, etc. I failed all the tests, but they still denied the
claim based on the fact that there was no physical proof of the chronic
fatigue.

I got a lawyer. He tried to fight the case, but without a doctor to sign an
affidavit that there was physical proof of the chronic fatigue, the lawyer
could not win the case.

It's a catch 22. Chronic fatigue cannot be proved medically to date, and
insurance will not pay LTD claims without the medical proof.

It's all extremely frustrating. I cannot work a full time job, and cannot
get the LTD insurance payments I'm entitled to.

wow, thanks for your 2 Cents, you are right on!
As I understand it from the attorney, my fight would be with L & I
again..
and I agree with you, they just wait to wear us down and since we are
sick...the thought of a fight is just exhausting to even think
about...what a
cycle to be in...ugh!
