TLC attorneys claimed that the postings were LACKING IN VERIFICATION:

Refractive Community Responds to Public Postings of Private Physician
Correspondences

Cataract & Refractive Surgery Today recently informed readers that excerpts
of private e-mails exchanged between physician members of the International
Society for Refractive Surgery (ISRS) had been posted on the public Internet
newsgroup alt.lasik-eyes, causing substantial concern among the refractive
surgery community. The newsgroup can be accessed by the public from the Web
site www.lasikcourt.com by clicking on "Links." ISRS recently provided us
with the following statement in response:

"It has come to the attention of ISRS that certain individuals may have
made, displayed, and disseminated copies of copyrighted and confidential
materials taken without authorization from our private computer network.
Attorneys for ISRS have notified these individuals of the apparent
violations they may have committed and have demanded that they cease any
unlawful activity. ISRS is currently investigating the methods by which
material has been misappropriated from its site and intends to take all
action necessary to protect its interests and the interests of those whose
right to privacy may have been violated."

In connection with this incident, Herman Sloane, MD, of Chicago, whose
private comments were among those published, said, "Although many of the
conversations seem innocuous to us, they may be quite shocking when taken
out of context and viewed by a public not normally exposed to such candid
exchanges."

It is my recollection that Hagele is the one who alerted ISRS that the
postings had appeared on this newsgroup and that was the start of
CRSQA's involvement in this matter.

Doctors and vendors at the annual AAO meeting in Anaheim, California
(November, 2003 if I remember correctly), confirmed that Dr. Machat had
been pushed around and spit on by fellow doctors at meetings he'd
attended after testifying on behalf of patient Steve Post. Dr. Machat
did not even attend the meeting that year.

The posts of the ISRS doctors were not taken out of context. The
entire threads were posted, and it's clear how they feel about doctors
who will stand up for a wronged patient.

The ISRS postings were accessible directly from a Google search. I
guess Google is nothing but a LASIK malcontent--that would explain it.
It WAS kind of Hagele to provide the verification.

Yes, thanks to Glenn for bringing the problem of doctors calling other
doctors
'whores' to the attention of public so that this information can be used by
judges
as evidence that the identity of expert witnesses should be hidden.

Glenn helped take down Mark Speaker.

It is amazing how Hanson makes a statement and then provides as
"proof" something that has absolutely nothing to do with his
statement.

I am not mentioned in the CRS Today story, nor am I quoted. I am not
the source for the CRS Today story. Another organization is cited as
the source for the story. The CRS Today story has nothing to do with
Dr. Speaker.

I have no doubt that you recollect something that is not true, Keller.
Those of us who have put up with your rants over the years have seen
the length and breadth of your imagination.

Not that it makes any difference, but the ISRS knew of the publication
of the private emails when I contacted them for verification. I knew
about the publication of the private emails because Hanson posted
about it here. Furthermore, the publication of the ISRS private emails
have nothing to do with Dr. Speaker's malpractice case.

Google does not provide content, it only indexes web pages published
by others. Suggesting that Google had anything to do with Hanson's
publication of private emails is like blaming the telephone because
you don't like what the person you are talking to said about you.

Dr. Machat has nothing to do with Dr. Speaker's malpractice case. Try
to focus, Keller.

It would appear that I must be quite talented. I have nothing to do
with Dr. Speaker. I had nothing to do with the malpractice case
against him. In fact, I'm not even sure that I've met Dr. Speaker,
although I'm sure I've heard him make presentations at one of the many
medical conferences I have attend.

As far as I can tell, the only connection between Dr. Speaker and me
is that we live in the same country, and an obviously
reality-challenged anti-LASIK zealot dislikes us both.
