| I believe the IRS would disagree with you on your statement that it
makes no difference in how you operate, as a 501(c)(3) is a public
charity, and a 501(c)(6) is a business league. Your organization is a
business league, with income derived primarily from certification fees.
The IRS is very clear on this point. You are pending nothing, as the
determination has been made, and you are a 501(c)(6). That information
is readily available from the IRS.
It isn't a molehill, it's an issue of telling the truth. You
misrepresent your organization to the public when you claim to be
anything other than a 501(c)(6). As long as CRSQA is CRSQA, it will
never qualify as a 501(c)(3), according to the IRS. Your claim that
nothing on your web site regarding your federal non-profit status is,
or has been inaccurate is simply not true, nor does it explain why you
refuse to state that you are a 501(c)(6) right up front.
You still state that CRSQA has a charitable, educational purpose (as in
a 501(c)(3)), and that you are a public benefit corporation, but
nowhere do you state that you are a business league or trade
organization established to improve business conditions for the
refractive surgery industry. The omission of your true tax
classification, together with your misleading verbiage and stated
purpose, are deceptive. CRSQA represents CRSQA surgeons and Glenn
Hagele. Period.
