I have a very specific legal question pertaining to NJ.
As many of you know, if you already have an illness like ALS at the
time you signup for group LTD insurance with your employer, they can
later potentially deny your LTD claim because the ALS was a
pre-existing condition.
I know somebody with very early onset ALS that's just been diagnosed,
but his employer has no idea he has it. The problem is he had signed up
for LTD with his New Jersey employer in mid-June, and it will be easy
to prove that symptoms began before June.
In NY I know the maximum lookback period, by law, is 1 year, meaning,
if you can stay employed for 1yr following the beginning of LTD
coverage, at that point they can no longer deny the claim because the
condition pre-existed.
Here's my question - I had heard from someone that in New Jersey, that
maximum allowable lookback period is 6 MONTHS. If this is true, that
would make NJ a much more disability friendly place from a group LTD
benefit standpoint.
Does anyone know if it's true that NJ has established 6 MONTHS as the
maximum lookback period? Again, this is not Social Security disability,
this question pertains to optional employer sponsored LTD coverage
tyically unerwritten by large insurance companies.
The employer employs 500+ employees in NJ.
