CNN-Girls sued for delivering cookies

DURANGO, Colorado (AP) -- Two teenage girls who surprised their neighbors
with homemade cookies late one night were ordered to pay nearly $900 in
medical bills for a woman who says she was so startled that she had to go to
the hospital.
The teenagers' families offered to pay Young's medical bills, but she
declined and sued, saying their apologies were not sincere and were not
offered in person. Young said the teenagers showed "very poor judgment"
"The victory wasn't sweet," Young said. "I'm not gloating about it. I just
hope the girls learned a lesson."
The girls declined comment after the ruling. Taylor's mother said the girls
"cried and cried."

They weren't offered in person!?!?!? They are being sued for showing up
unexpectedly. I guess she wanted to add insult to injury by suing them for
double the amount when they did it again.

| Depending on how late late is, maybe they used poor discretion, but
SUING THEM for trying to be nice? That takes the cake - or the cookies.

from the CNN web site:
"Wanita Renea Young, 49, said she was at her rural home south of
Durango around 10:30 p.m. when she said saw "shadowy figures" outside
the house banging repeatedly on her door.
She yelled, "Who's there?" but no one answered, and the figures ran
away."
I would have definitely called the police on them!!! Sure they are
saying they were just trying to be "nice," but I don't think that is
the real story. They left a note saying who the cookies were from but
used only their initials. Come on people, would you have eaten the
cookies????

An update to that was posted today regarding all the people who called in
and offered to pay the 900 bucks the old bag sued for and won. That
included one of the cookie companies, can't remember but I think it was Mrs.

You wouldn't be scared if you were an elderly lady alone and had people
knocking on your door late at night? I sure would love to live in your
world. I'm 33 and I'd be scared if that happened.

Likewise, Bob! especially if you think what they did was okay and just
harmless fun. Sometimes I come home exhaused from work and can be
soundly asleep at 10:30.
The girls were just plain stupid and deserved it.

Uhm, didn't I read that the girls' families offered to pay the woman's
medical bills, and she refused? So if they offered to pay her medical
bills, what was the point of suing?

I do think it is ridiculous that they were sued. However, I believe that
they definitely learned their lesson (well, probably not since they
apparently didn't cough up the money to pay. I would've voted for community
service or something else that they would have to physically do
themselves). However, I can certainly understand how the woman would've
been scared.

| I probably would have just opened the door to see who was there! And, I am
71, which I guess you would call elderly, though I now think of "elderly" as
someone approaching 90. Perspectives change. You don't know how she yelled
through the door with the "Who's there", either. Maybe SHE scared the
girls. Also 10:30 isn't that late around here. We have a dog whose bark
probably would have scared them away before I got there to open the
door--our Saluki is turning into a GREAT watchdog--something we've never had
before.
I think it's hard to judge without knowing all the circumstances, but I
certainly would not have sued once I found out who they were--but, it
wouldn't have sent me to the hospital, either, unless I tripped over the dog
on the way to the door!

If you are knocking on my door at 10:30, you darned well better have an
emergency. I cannot believe people let their young kids run around outside
late at night like that. My DH doesn't even like phone calls after 9PM and
I am a bit torn on those - depending on the night.
| |
| Barbara Carlson 2005-02-09, 3:10 pm |
| I agree that young girls shouldn't be out alone at 10:30, but again, it
depends on the neighborhood! I rarely go to bed before midnight, and
anyone who knows me knows my cut-off time for phone calls is 11:00 p.m.
Again, there are so very many circumstances that we don't know that it is
hard to judge. It was poor judgment on the girls part and also not the hour
to be trying to do friendly things for neighbors--and no I would not have
eaten the cookies without knowing who sent them. But refusing to simply
accept the medical expenses which were offered and suing--I think not!

Jeannie, I'm earlier than that. Most family and friends know I won't answer
my phone after 5 p.m.; that's why answering machines were invented. Usually
I also turn off my computer then and head for the peace and quiet of the
front rooms. No way do I let the phone rule my life now as it did years
ago.

I have gotten to where I hate talking on the phone. There are a few people
I will talk for a while but other than that, I cringe every time the stupid

| Man, I don't know who you are blackrots, but something is black and
rotten. If there was a law suit every time a teenager showed bad
judgment, can you just imagine the courts would hear anything else?
Good grief. If I was scared, I'd call the cops, but I can't imagine
going to the expense of suing over something like that. If the kids
were out there playing trick 'r treat type nasty games, it it would be
different.

You know, that's exactly what my husband said, I believe that they
definitely learned their lesson. Only he was referring to learning their
lesson about doing anonymous kind things for other people.
I'd say they learned it, but good.

Goodness! What on earth! I'm absolutely shocked that everyone is being
downright mean to them. They were teenagers, so they didn't realize that
they might frighten somebody, but for Pete's sake, if they TP'ed a house,
that would be okay. If they went out egging that would be okay. But the
little brats, damn them, BAKED COOKIES for the neighborhood and delivered
them anonymously.
HOW DARE THEY.

Wow. Sometimes we aren't even all home by 9 p.m. for somebody TO call. If
we are, we might just be getting around to dinner. And nobody I know,
including my 86-year-old grandmother, is shocked by a phone call after 9:00

We are very early risers and both work a good bit and our family time is
our family time. Plus, we both have cell phones and people can pretty much
reach us any time of the day - no need to call after 9 in his opinion
unless it is an emergency. We eat early, we spend family time, we get our
kid in bed, we spend time discussing things that we need to discuss, etc.

| Oh dear... you just reminded me of the time my son TP'd and egg'd a friends
house when he was a senior in high school. They got caught, had to rent a
power washer and clean the house, and clean up the mess. I think the time
equaled the crime. (I can't count the number of times our house was TP'd -
and when we caught them we invited them in and had a good laugh).
If that lady was our neighbor she probably would have sent us into

| Yep, you probably do. Lots of people really don't know how to take time
zones into account, or even think to check what time zone they're calling if
it's a business. Everyone has gotten used to businesses with 24-hour
telephone coverage, and they forget someone renting out a house is not a
major hotel chain.

| My DH goes to bed at 10, anyone calls after 10 they had better be half dead
or they will soon wish they were. Actually any call after 9 garners a growl
from him. Me, I'm up late and if he wasn't here I'd take calls all night.
Anyone stops by unexpectedly any time of the night and he will snarl. Who
the hell is that?

I sometimes forget about the time difference when I call my friend in
Alaska. I will call her on a weekend morning and it is REALLY EARLY there!
She usually tells me what time it is there and she will call me back. OTOH,
she has called me really really late here, so I guess we are even.

Thank you for that bit of info!! I think I have your address around here

Yeah, Bob, I bet you would like a couple of teenage girls leaving

We have a very nice single mother for a neighbor and we are trying to break
her of her habit of thinking that every nice thing we do for her requires
that she give us some treat. We don't expect anything in return.

There are a number of freeware programs for PCs and Palms that will give
you local time for anywhere in the world. I try to use them whenever
I'm communicating with someone outside the continental US.

| I can't imagine anyone thinking it is okay to drop in, unannounced, at
10:30 p.m. Do these girls have no manners? Do they have no sense of
propriety? Did they ask their mother's permission before setting out at
that time of night?
I don't care what neighborhood anyone lives in, it is rude and dangerous
to visit someone after dark if they aren't expecting you. Quiet,
upscale neighborhoods also have crime visited upon them as do nice quiet
country village and farm homes. I think suing someone over it is nuts,
but there may be more to this than meets the eye. Why didn't the girls
call first? Why didn't they leave their names on the note? How long
had they known this neighbor? Two teenage girls coming to one's door
after dark could mean violent trouble for the occupants of any house.
The girls were wrong, their parents were wrong, and so was the neighbor
for suing.

| I can't be as magnanimous since jails are full of teenagers who were
arrested for burglary, home invasion, prostitution, and yes, even
murder. If their teenage years were too young for them to understand
the gravity of the situation, then they were too young to be out at
10:30. If they were in their mid to older teens, they were certainly
old enough to know what this could have caused. I can't believe anyone
of any age above 12 would think delivering cookies (or anything else)
after dark and at 10:30 at night would be a wise thing to do.
I wonder how this would have played out here if it had been two teenage
boys instead of girls.

| Let's face it... few of us were renowned for always having good
judgment when we were teens. It's something that develops with
experience and age, punctuated by mistakes and goofs that we'd just
as soon forget about. This sounds like one of those things that can
best be described as "Well, it seemed like a good idea at the time."
Makes for an expensive lesson in any case.

| That's why God created parents. Unfortunately a "goof" in this day and
age can be much more deadly than even 20 years ago.
